Imperial Overhead Garage Door Repair – Terms & Conditions

Parties: This Agreement, effective as of the invoice date, is between Imperial Garage Door Repair (“Contractor”) and the customer listed on the invoice (“Customer”).

The Contractor may operate services through affiliated sister brands, including but not limited to Trusty Garage Doors and American Overhead Garage Doors. All technicians are authorized representatives of Imperial Garage Door Repair for the purposes of job execution, signature collection, and payment processing.

Project Description: The Contractor agrees to provide all necessary labor, equipment, and materials to complete the work detailed in the invoice titled “SERVICES/MATERIALS.” If additional space is needed for the description, it will be provided on attached sheets.

Payment Policy: A 50% deposit is required prior to commencement of work. This deposit is non-refundable. Deposits may be charged over the phone. Full payment is due upon completion of the work. Once work begins or parts have been delivered, the sale is considered final.

Coupons are valid only at time of estimate or repair and are not combinable with other offers. Credit cards and/or checks are accepted. NSF, cancelled, or returned checks will incur a $50 fee.

Non-Payment and Ownership of Materials: Title and ownership of all materials and equipment remain with Imperial Garage Door Repair until full payment is received. In the event of non-payment, the Contractor reserves the right to pursue all remedies under Texas law, including filing a mechanic’s lien or initiating legal action to recover amounts owed. The Customer agrees to be responsible for all costs associated with collection, including attorney fees. Any delivered but uninstalled materials remain the property of the Contractor and may be reclaimed if payment is not received.

Lien Rights Disclosure: In accordance with Texas law, the Contractor reserves the right to file a mechanic’s lien against the property for unpaid labor, services, or materials. This lien may affect the title to your property.

Credit Card Transactions: Customer authorizes the card issuer to pay the amount indicated on this invoice and acknowledges receipt of services. All services and parts are non-refundable and due upon completion. A convenience fee of up to 4% applies for credit card payments.

Authorized Work and Property Access: Customer affirms that they are the property owner or have authority to permit the Contractor to perform the services detailed in this agreement. Technicians are authorized to act on behalf of the Contractor to complete services and obtain signatures or payments.

Preparation Requirements: The garage must be cleared at least 10 feet back from the door opening prior to installation or service.

Warranty Information: Product warranties for motors, doors, and sections are processed through the manufacturer and require a copy of the invoice for validation. If the Customer has purchased a Limited Warranty Policy from Imperial Garage Door Repair, the following terms apply:

Usage Policy: Customer must stop use of door and await technician inspection Scope: Covers normal wear only; damage from external impact is excluded Non-transferable and non-refundable

Text Message Communications: By providing a phone number, the Customer consents to receive service-related and promotional messages from Imperial Garage Door Repair. Message and data rates may apply. Text STOP to opt out or HELP for support. Consent to marketing texts is not a condition of service.

Arbitration Agreement: All disputes arising from this agreement shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.

Attorney Fees: The prevailing party in any arbitration or legal proceeding is entitled to recover reasonable attorney fees and costs.

Governing Law: This Agreement is governed by the laws of the State of Texas.

Acknowledgement: By signing, the Customer agrees to all terms and conditions stated above.
